The problem with this it effects Bonus points, as they are tied to low stats, and with your system, you could only generate one. Marvels do have a slightly different format in 3rd ed, so I am not quite sure how you work out Build points etc, but I do like the flexibility the 2nd ed brought to creating literally anything. Perhaps the build cost should be based on the black die penalty, maybe 1 BP per 3 black dice?
